29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) Facility; On or about May 5, 2021 and times prior, the employer exposed employees to struck-by hazards in that the employer permitted employees to operated a forklift (Hangcha #25) whose backup alarm and backup light were not in safe operating condition and failed to take the forklift out of service or perform repairs. b) Facility; On or about May 5, 2021 and times prior, the employer exposed employees to struck-by hazards in that the employer permitted employees to operated a forklift (Unit 935, serial number 4354) that did not have a functioning seatbelt and failed to take the forklift out of service or perform repairs.
