29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: At a worksite located at 111 W Fountain Rd, Webb City, MO: Employees are exposed to including but not limited to injuries to the mucous membranes and respiratory tract. This was most recently demonstrated on February 13, 2020, where the employer requires employees to wear N95 or tight fitting elastomeric respirators while operating equipment and performing duties in the bagging, mixing, and grinding areas, or any area where dust is generated. The employer is failing to protect employees as they have not had the employees medically evaluated prior to use of a respirator.
