29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: Site- Employees were not protected from asphyxiation and entrapment hazards where permit required confined spaces were entered without implementing the written permit required confined space program. On or about December 5, 2017; December 11, 2017; and December 19, 2017 employees entered Silo 1 and on or about January 8, 2018 employees entered Silo 2 without implementing the written permit required confined space program or declassifying the permit spaces to non permit spaces.
