29 CFR 1910.1025(m)(1)(iii): Employers must include lead in the hazard communication program established to comply with the HCS (� 1910.1200). Employers must ensure that each employee has access to labels on containers of lead and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l) of this section. (a) The employer is failing to protect employees from toxic lead hazards by ensuring each employee is trained in accordance with the requirements of HCA and paragraph (l) of this section. This was most recently documented on or about July 27, 2016, when the employer failed to demonstrate that this information was included in Hazard Communication training of employees. Employees are exposed to lead in the following areas: (1) In the employee restroom, on the sink faucet and handles, lead was present at 2016.3000 micrograms in a 100 square centimeter sample. In the employee restroom, on the light switch, lead was present at 71.2920 micrograms in a 100 square centimeter sample. (2) On a table in the range lobby, lead was present at 104.5000 micrograms in a 100 square centimeter sample. (3)On the counter inside the range attendant's booth, lead was present at 48.5030 micrograms in a 100 square centimeter sample. (4) On the kitchen counter, in front of the coffee maker and dish drying rack, lead was present at 13.7390 micrograms in a 100 square centimeter sample. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
