29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: On and before April 11, 2016, the employer did not have a permit required confined space program. Employees were exposed to an engulfment hazard, in that, while servicing the mixer/agitator that extends down into the oil in the lubrication system container, employees had to lean over the top handrail and break the plane of the container opening with potential to fall into the 5 foot diameter 4.5 foot deep container that was labeled "Danger, Confined Space, Do Not Enter".
