29 CFR 1926.65(i): The employer did not develop and implement a program, which is part of the employer's safety and health program required in 29 CFR 1926.65(b), to inform employees, contractors, and subcontractors (or their representatives) actually engaged in hazardous waste operations of the nature, level and degree of exposure likely as a result of participation in such hazardous waste operations: (a) On and after 01/18/2016, at GE Power, Building 5, areas 3 East and 4 East, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, elemental mercury, soil contaminated with mercury and wood contaminated with mercury. The employer did not to inform employees actually engaged in hazardous waste operations of the nature, level and degree of exposure likely as a result of participation in such hazardous waste operations.
