29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On or about April 28, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure personal protective equipment was used when hazards capable of causing scalding injuries were encountered. Employees working in the kitchen area of Jack's Restaurant were required to use a Vulcan K-Series Pressure Kettle during food preparation operations. During these operations, employees opened the kettle to release pressurized steam and used water-permeable oven mitts to retrieve food items stored in water at a temperature of approximately 200 degrees Fahrenheit. Appropriate personal protective equipment was not required and used to protect employees from scalding injuries during these operations. This condition exposed employees to scalding injuries from near-boiling water.
