29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and the employer had not developed or implemented a chemical inventory which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) 156 West Harrisburg Avenue, Elizabethtown, PA 17022: On or about January 14, 2025, employees were exposed to hazardous substances, such as sanitizers used for cleaning and anhydrous ammonia in the ammonia refrigeration system, and the employer did not develop, implement, and/or maintain at the workplace a written hazard communication program. b) 156 West Harrisburg Avenue, Elizabethtown, PA 17022: On or about January 14, 2025, employees were exposed to hazardous substances, such as sanitizers used for cleaning and anhydrous ammonia in the ammonia refrigeration system, and the employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet in the workplace. Frozen Food Development, Inc. and its successors were previously cited for a violation of this occupational safety and health standard, 29 CFR 1910.1200(e)(1), which was contained in OSHA inspection number 1736998, citation number 1, item number 4-a, and was affirmed as a final order on September 24, 2024, with respect to a workplace located at 156 West Harrisburg Avenue, Elizabethtown, PA 17022. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
