29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: [As referenced in 1910.1052 (k)(1)] a) On or about October 29, 2024 - Kamesi Corporation - 111 E 100 St, Apt 2B New York, NY 10029 - Bathroom Employees performed bathtub refinishing using hazardous chemicals, including but not limited to Hoodstrip-888 Semi-Paste Remover, which contains 75-90% Methylene Chloride (MC). Exposure to MC can result in serious health risks, including central nervous system depression, unconsciousness, and potentially death through inhalation or skin absorption. The employer failed to implement or maintain a written hazard communication program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
