29 CFR 1926.1427(f)(1)(i): Through an evaluation, the employer did not ensure that each operator was qualified by a demonstration of the skills and knowledge, as well as the ability to recognize and avert risk, necessary to operate the equipment safely, including those specific to the safety devices, operational aids, software, and the size and configuration of the equipment. Size and configuration includes, but is not limited to, lifting capacity, boom length, attachments, luffing jib, and counterweight set-up: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer did not ensure an operator-in-training had been evaluated by the employer and qualified by demonstration involving skills and knowledge and the ability to avert risk while operating the Liebherr 550 HC40, 20-ton tower crane. The operator-in-training of the tower crane hoisted subcontractor employees on a Doka work platform that did not meet the requirements for hoisting personnel. The platform failed causing two employees to fall 40 feet and sustaining serious injuries. This condition exposed employees and subcontracted employees to fall and struck-by hazards.
