29 CFR 1910.1053(d)(3)(iv):Where the most recent exposure monitoring indicated that employee exposures were above the PEL, the employer did not repeat such monitoring within three months of the most recent monitoring: a) 3370 Drennan Industrial Loop North, Colorado Springs, CO 80910 (Colorado Ready Mix Plant): On or about March 3, 2023, and at times prior, employees were exposed to health hazards from silica dust. The employer failed to repeat monitoring within three months of the most recent monitoring that occurred in November 2022. The November 2022 silica monitoring report, performed by Travelers, indicated a Plant Operator was exposed to silica at more than three times the OSHA Permissible Exposure Limit.
