29 CFR 1926.1427(a)(1)(i): The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section: a) Front of building, South side parking area - On or about March 17, 2022 and at times prior thereto, the employer did not ensure that the Effer 170 5S knuckle boom crane operator had been trained, certified/licensed, and evaluated to operate such equipment. On March 17, 2022 the crane operator was fatally crushed by the boom of the crane while standing at the operators controls.
