29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a)C & C Construction, Inc. at 82 Burlington Northern Santa Fe Railway, Hazel SD 57242: On or about and at times prior to May 22, 2020, the employer did not ensure fall protection was utilized when employees were performing welding activities and grain bin dismantling activities while standing on a pallet resting on the forks of a Lull, Model 844C - 42 Rough Terrain Forklift. The wooden pallet was used to lift personnel to the upper levels of the grain facility. This condition exposed employees to fall hazards up to forty feet.
