29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): In the warehouse: On or about November 13, 2019, employer did not ensure that forklifts found in need of repair were taken out of service until restored to safe operating condition. This condition exposed employees to struck-by hazards in the following instances. a) Toyota Forklift: Serial No. 70983, Model 8FGCU18- was missing the left side rearview mirror, back-up alarm, running strobe light. b) Toyota Forklift: Serial No. 30844, Model 8FGCU18- was missing the rearview mirrors, back-up alarm, horn, running strobe light and seat belt. c) Toyota Forklift: Serial No. 16584, Model 8FGCU15- was missing the left side rearview mirror, horn, emergency brake, left hand side front flood light. d) Toyota Forklift: Serial No. 22321, Model 8FGCU25- was missing the rearview mirrors, horn, back-up alarm, running strobe light.
