29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: Recycling Center; On or about 8/16/18, the employer did not perform an exposure assessment to determine employee exposure to silica when working at the recycling center, performing construction debris crushing operations. While water was used to control the dust at one end of the operation, an employee working before the wetting down was exposed at 48.3 ug/m3 for an 8 hour TWA. The action level is 25 ug/m3 and the PEL is 50 ug/m3.
