Text For Citation: 01 Item/Group: 005A Hazard:
29 CFR 1910.120(q)(2): Elements of an emergency response plan. The employer shall develop an emergency response plan for emergencies which shall address, as a minimum, the following areas to the extent that they are not addressed in any specific program required in this paragraph: a) On or about February 21, 2017, employees were performing tasks of On-Scene Incident Commander and Hazardous Materials Technician activities during an uncontrolled ammonia release at the facility located at 317 N Rosera Street, Lena, Wisconsin. The employer had developed an Emergency Action Plan that stated: "It is the policy of Saputo Cheese not to mitigate an event." b) On or about February 21, 2017, the employer had not developed a program ensuring employees performing tasks of On-Scene Incident Commander and Hazardous Materials Technician activities during an uncontrolled ammonia release at the facility located at 317 N Rosera Street, Lena, Wisconsin, received the appropriate training. c) On or about February 21, 2017, the employer had not established procedures to prevent employees reporting to work and other contractor employees from entering the property/facility during an uncontrolled ammonia release at the facility located at 317 N Rosera Street, Lena, Wisconsin. d) On or about February 21, 2017, the employer had not developed a program to provide appropriate personal protective equipment to employees performing Hazardous Materials Technician activities during an uncontrolled ammonia release at the facility located at 317 N Rosera Street, Lena, Wisconsin.
