29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Production Area; On February 28, 2017 the employer exposed employees to noise hazards, in that employees using a F&K CI Press (Model 16S-8, Serial No 58256/3086) to print food labels were exposed to continuous noise at 84.57% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 88.7 dBA during the 440 minute sampling period on February 28, 2017. The exposure calculation included a zero increment for the 40 minutes not sampled.
