29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench: Zee Construction Co., Inc. 4930 Woodville Rd, Northwood, Ohio: On or about May 14, 2016 the shield system that was in place was not installed to provide protection against cave-in hazards from the sidewalls of the excavation, in that there was approximately 8 feet of unprotected sidewall below the bottom of the shield. An employee was struck by soil during a cave-in incident.
