29 CFR 1926.651(k)(1): The employer did not ensure that: Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) When excavating 7 feet deep in front of the building the employer did not provide sufficient safety inspection when excavating around utility pipes and old masonry foundation walls. Employees were exposed to excavation hazards. Location: 12 E 8th Street, New York, N.Y. On or about 9/30/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
