29 CFR 1926.451(g)(2): The employer did not provide fall protection for employees erecting or dismantling supported scaffolds: (a) The employer does not require each employee to use a form of fall protection during scaffold erection or dismantling. This violation was most recently observed on May 31, 2013 at the worksite located at 1900 Northern Boulevard in Manhasset, NY where an employee was erecting the north fabricated frame scaffold without fall protection, exposing him to fall of 13' to the ground below. To abate this violation, the employer must ensure that its employees performing scaffold erection are protected from falls; and that no employee is permitted to erect scaffolds without fall protection, unless a competent person has determined that it is infeasible or the use of such protection creates a greater hazard.
