29 CFR 1926.651(k)(2): Where the designated competent person (for excavations) found evidence of a situation that could result in a possible cave-in, idications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions were to taken to ensure their safety: a) The employer did not have a designated Competent Person (for excavations) make a determination to widen the excavation when the employer found the hole was too narrow to fit a ladder in with the employee. Employee was exposed to excavation hazards (dirt, rock collapse, utilities hazards; electric, gas) when working in the 8 ft deep pit without a ladder to get out. Location: 162 E 64th St, New York, N.Y. On or about 8/9/2012 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
