29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: At numerous locations throughout the facility the employer is not requiring the use of protective footwear where hazards capable of causing injury or impairment are encountered. These hazards include but are not limited to the prolonged exposure to contaminated water (water mixed with animal by-products such as but not limited to blood, fat, organ and muscle meats), animal by-products, falling objects, slipping hazards (that would be addressed with a non-skid or slip resistant soled boot), various bacteria or diseases associated with bovine exposure, and dropped knives: a) Slaughter Department: Throughout the department employees are working where the walking/working surface is covered with animal by-products and moisture creating slipping hazard as well as skin exposure to these elements. There are also hazards associated with dropped objects. b) Cattle Yard: The employees are exposed to crushing hazards due to the movement of cattle as well as the added hazards (disease) of walking in an area where bovine feces and urine are present. c) Maintenance: Maintenance employees work throughout the facility and in areas where the walking/working surface is covered with animal by-products and moisture creating slipping hazard as well as skin exposure to these elements. The employees are also exposed to crushing hazards based on the equipment that they maintain and repair (motors and gear sets for example). These employees would also have the additional hazards of working with lubricants that could affect the footwear. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
