Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, and other fire hazards while operating non- approved powered industrial vehicles in classified locations: (a) For the employees using a Bobcat S130, Serial #527313235, diesel powered skid steer to scoop sugar dust into the remelt tank without the skid steer having the proper DX rating for a Class II, Division 1, location, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. (b) For the employees using a Skyjack scissor lift, Model SJ 1113219, Serial #224915, for repairs in the bulk sugar loading area for maintenance activities without the scissor lift being rated for a Class II, Division 2, location, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the NFPA 505, National Fire Protection Association - Fire Safety Standard for Powered Industrial Trucks Including Type Designations, Areas of Use, Conversions, Maintenance, and Operations, Section 4.2.6 and Section 4.2.7.1, including, but not limited to, ensuring that appropriate powered industrial equipment is used in classified areas.
