Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a)Integrity Trucking LLC at Merit Well Girltey 31-23 WCR 38 - 25.5, Gilcrest, CO 80623: On or before October 24, 2008, the employer did not ensure that, prior to initial use, a modified, repaired, or reinstalled base-mounted drum hoist was functionally tested, with a written report prepared and placed on file. The employer purchased a 2000 Freightliner Classic truck, serial number 1FUPCXZB6YPF04439, and placed the truck and hoist into service without ensuring the hoist, brakes, wire rope, hook, and sheep's foot would support the required loads. For example, if the sheep's foot was to fail, the wire rope could rebound through the rear cab window and injure the driver. Condition exposed employees to struck by hazards. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, one feasible and acceptable abatement method can be found in the American National Standards Institute ASME B30.7 - 2001 Section 7-2.2.2, which provides that prior to initial use, altered, modified, reinstalled, or repaired hoists shall be functionally tested, and a written report of such test be prepared and placed on file.
