Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to being struck by the refuse trucks or vehicles operating in the area of the waste collectors: a) Chatam Lane, Port Richey - On or about 5/25/07 - employer did not require employees collecting waste alongside roadways to wear high visibility apparel. One feasible and acceptable method of abatement is to require the use of high visibility apparel in adherence to safe practices and the employee requirements in accordance with ANSI Z245.1 - 2007 Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements, specifically by: requiring high visibility apparel as appropriate to the tasks assigned and conditions that employees will experience as prescribed in ANSI/ISEA 107 -2004, High Visibility Apparel, Appendix B and C.(Paragraph 6.1.7.8 of ANSI Z254.1 - 2007).
