Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the vertical spacing of the first rung of the fixed industrial ladder to the ground was greater than 14 inches: a.Barboursville Plant, Rock Crusher - Employees gain access to the control platform for this machine by climbing a fixed ladder. The distance from ground level to the first rung of the ladder was approximately four feet creating a hazard for employees when accessing or decending the ladder, as observed on 5-23-07. b.Barboursville Plant, Rock Crusher - Employees gain access to the engine platform for this machine by climbing a fixed ladder. The distance from ground level to the first rung of the ladder was approximately four feet creating a hazard for employees when accessing or decending the ladder, as observed on 5-23-07. ABATEMENT NOTE: Feasible abatement for this violation includes installation of a new fixed or modification of the current ladder such that the distance from the ground to the first rung is 14 inches or less.
