Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing injuries in the event of an accident / equipment roll over and the provided seat belt was not utilized: (a)Excavation Project: The provided seat belt was not worn by the operator of the Kobelco excavator (Model# SK13689LC-1E) as observed on 9/16/08. (b)Excavation Project: The provided seat belt was not worn by the driver of the Ford dump truck (L9000 USDOT 559602) as observed on 9/16/08. Abatement Note: Among other methods, one feasible an acceptable abatement method to correct this hazard is to enforce the use of seat belts. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
