Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls fro m a ladder: (a) On or about May 18, 2005, the 20 foot upper section of the fiber glass extension ladder located just east of the spin cast area had been separat ed from the bottom section and used as separate ladder for access up to the elev ated sections of the equipment. The separation and use of the extension ladder s ections was a use contrary to the way the ladder was approved for use. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with Section 9.3 .10 of the American National Standards Institute (ANSI) A14.5-1992, Safety Requi rements for Portable Reinforced Plastic Ladders and ensure that top sections of sectional ladders are not used as a separate ladder unless the user equips them with safet y feet.y
