Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were expose to: An excavation that was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). Location: St Raymond's Cemetery On or About: 05/23/2000 Employees performing disinterments were not protected from cave-ins. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO FOLLOW THE GUIDELINE SET FORTH IN 29 CFR 1926.652(a)(1): NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
