Text For Citation: 01 Item/Group: 005 Hazard: LIFTING
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)unsafe operation of equipment. Refuse Collection Truck # 84 with rear loader container lifting system with a container latchup mechanism that was not equipped with a device to restrict the lateral movement of the trrunnion bar in the pivot plate at the time of the accident on July 30, 1997 at Hobgood Academy -¿Ref ANSI Z245.1- 1992, paragraph 7.2.2.6.1 c) "Among other methods, on feasible and acceptable abatement method to correct this hazard is installation of a flange at the ends of the trunnion bar on the front of the portable container."
