Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards associated with falls from an elevation. Employees were potentially exposed to a fall of approximately 40 feet due to employees having to climb railings and supports to gain access to the walkway to the rolled corn and the soymeal bins. The USA Standard A64.1 - 1968 requires stairs (ladder) for access from one structural level to another. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: a)Install a stair system that would allow access to the walkway in accordance with USA Standard A64.1 - 1968. b)Install a ladder system that would allow access to the walkway in accordance with USA Standard A64.1 - 1968. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
