29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) R. Nichols Civil Contractors LLC: On or about June 27, 2025, employees were exposed to cave-in hazards while attempting to repair a water main in an unprotected trench in excess of 5 feet in depth. The employer failed to protect each employee performing work in an excavation from cave-in hazards by using appropriate protective systems designed in accordance with paragraph (b) or (c) of 29 CFR 1926.652.
