29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Front Roof Access Ladder- On or about September 21, 2024, employees working on a roof were exposed to a fall hazard of approximately eighteen (18) feet, four (4) inches from the use of a portable ladder that was used to gain access to the roof that was not extended at least three (3) feet above the upper landing surface and was not secured at its top. b) Upper Roof Access Ladder- On or about September 21, 2024, employees working on a roof were exposed to a fall hazard of approximately twenty-eight (28) feet from the use of a portable ladder that was used to gain access to the roof that was not extended at least three (3) feet above the upper landing surface and was not secured at its top. Abatement: With respect to all future worksites in Pennsylvania, the employer must cease and desist from permitting employees to work with pneumatic nail guns, unless each employee is wearing eye protection equipment. Abatement certification and documentation to address the specific violation observed on or about September 21, 2024, is also required. The Date By Which Violation Must Be Abated listed below is for the specific violation observed on or about September 21, 2024. The cease and desist provision listed above is an ongoing obligation.
