29 CFR 1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Employees engaged in material handling operations located at 84504 North State Highway 11, Burwell, Nebraska 68823, were exposed to struck-by hazards in that employees were operating forklifts without successfully completing the training requirements specified in the standard. This was most recently documented on or about April 10th, 2024. Instances of failure include but are not limited to: i. Employees did not receive formal instruction. ii. Employees did not receive practical training. iii. Employees did not receive an adequate hands on performance evaluation.
