29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, or brakes set. On or about February 16, 2024, the employer did not ensure a powered industrial truck operator who dismounted the truck (Nissan Model CPH01A15V Serial No. CPH01-920903) to adjust a metal carriage on top of a welding table within reach of the forks and while within 25 feet of the truck in view, had the load engaging means fully lowered, controls neutralized, and brakes set.
