29 CFR 1910.1200(e)(1): The employer failed to develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about November 6, 2023, the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees that use different chemical products including but not limited to Zinc Metal, ZRC Cold Galvanizing Compound, Carbon and Alloy Steels, Zirconium and Carbon Steel, and Gas Mixture (Argon 50-90%, Carbon Dioxide 10-50%) for operations including grinding, mig welding, and spray-painting metal sub frames of trucks. The program must include how to train employees on hazardous chemical products used in different operations and how to identify the different hazards located in the SDS and labels on the containers for products including but not limited to respiratory hazards, skin irritation and sensitization, and damage to the central nervous system.
