29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a): a) Facility-Wide - Employees were exposed to possible explosive and burn hazards caused by the employer not developing or implementing a written Emergency Action Plan, on or about October 11, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
