29 CFR 1910.28(b)(3)(i)(A): The employer did not ensure that each employee on a walking-working surface was protected from falling into any hole or pit that was 4 feet (1.2 m) or more above a lower level by a cover or covers: a) Water Pit in Production Area; On or about August 22, 2023, and at times prior, the employer exposed employees to fall hazards, in that employees were required to dump hazardous waste into a water pit and collect water from the water holding tank located above the water pit which did not contain a covering over the water pit that was approximately 4 feet deep.
