29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a)Core Framing, LLC at 5501 - 5503 South Huntwood Avenue, Sioux Falls, SD 57110: On or about and at times prior to July 13, 2023, the exposing employer did not ensure that portable ladders being used to access the garage roof of the residential property through a second-story window were positioned so that the side rails extended at least three feet above the upper landing surface or that the ladder was secured at its top to a rigid support and a grasping device was provided to assist employees while mounting and dismounting the ladder. This condition exposed employees to fall hazards from the ladder while accessing though an upper window.
