29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, the employer did not ensure that the Caterpillar Forklift, Model T50DSA, Serial Number: 2LC01724 in the receiving area, was maintained in a safe operating condition and removed from service when unsafe conditions were identified. The mount for the propane cylinder was damaged and not taken out of service or repaired by an authorized person. This condition exposed employees to fire hazards. (b)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, the employer did not ensure that the Clark Forklift, Model: gcs-25mc Type C Serial Number: g138mc-0438-5519fa in the shipping area was maintained in a safe operation condition and removed from service when unsafe conditions were identified. There was no observed operator seatbelt for this vehicle. This condition exposed employees to caught in, struck-by, or thrown-from hazards related to vehicle tip-overs or crashes.
