29 CFR 1926.1431(a): The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions: On or about November 16, 2021, on the north side of the intersection of US Highway 62 and Sundowner Ranch Avenue, employees were using a Venturo ET36KX truck mounted crane to lower and hoist employees in and out of the sewer well with a winch attached to a boatswain's chair.
