29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: a.) On or about February 8, 2022, the employer did not ensure that employees working at the 80T-1 Press were exposed to levels of respirable silica at or above the action level. An employee working primarily on press 80T-1, was exposed to 31.62 ug/m3 of respirable crystalline silica over a sampling period of 428 minutes, approximately 1.26 times the action limit. Exposure calculations included a zero increment for the time not sampled.
