29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) Delaware Route 299 and Willow Grove Mill Drive, in Middletown, DE 19709: On or about 4/12/2021; the employer did not ensure a competent person was on site to make the required inspections prior to employees being directed to enter the trench. No protective systems were noted in the trench or at the site for use during this excavation.
