29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- Lot 549, 2 Westmont Drive, Medford NJ: Employees were exposed to fall hazards, up to and in excess of 13 feet to the ground surface below, when walking and working at a residential structure's unprotected window openings without the use of fall protection. Condition observed on or about 10/20/2020. b- Lot 549, 2 Westmont Drive, Medford NJ: An employee was exposed to fall hazards, up to and in excess of 13 feet to the ground surface below, when working with one foot on the top step of a aluminum extension ladder and the other foot resting on the exterior surface of a residential structures window opening. At the time of the exposure this employee was not utilizing fall protection. c- Lot 549, 2 Westmont Drive, Medford NJ: Employees were exposed to fall hazards, up to and in excess of 13 feet to the floor below, when accessing the second story of a residential structure by entering onto the floor and exiting the floor by standing on the exterior of an unguarded window opening when coming to and from the top step of an extension ladder. At the time of the exposure these employees were not utilizing fall protection. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
