29 CFR 1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record: (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure a written fall protection training certification record was prepared which included the identifies of employees trained, dates of training, and the signatures of the trainer or employer. Employees were working on the roof of a post-to-truss cattle barn installing steel corrugated roof panels while improperly using vertical lifelines looped around trusses with the snap-hook connected directly to the rope. This condition exposed an employee to a fall hazard of approximately 16 feet. Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. Brothers Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.503(b)(1), which was contained in OSHA inspection number 1395838, citation number 1, item number 1c, and was affirmed as a final order on July 24, 2019, with respect to a workplace located at 1201 South Hyde Park Avenue, Sioux Falls, SD 57106.
