29 CFR 1926.1101(h)(2)(i): The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator: a) 125-133 West 2nd Street, Plainfield, NJ 07060 - Outside lot Employee(s) of Black Dog Construction cleaned up construction debris containing between 70% and 75% chrysotile asbestos. The employer required that employees use half face respirators and N95 filtering facepiece respirators (dust masks) and without fully implementing a respiratory protection program to include elements such as but not limited to a written program, medical evaluations and training. Violation occurred on or about November 5, 2019. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19
