OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from potential permanent disabling injuries such as but not limited to broken bones, electric shock, or death as a result of a struck-by and electrocution hazard as a result of using the Cleasby Truck-Mounted Conveyor that had a missing rotation function lever. This was most recently documented on November 6, 2017 at the jobsite located at 5699 Indian Trace Road, in Osage Beach, Missouri when the employer did not ensure the rotation function lever was present and in working condition. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Ensure daily maintenance as described by the manufacturer on page 4-1 of Cleasby instruction manual is conducted. 2) Ensure conveyor controls are functioning, inspected and repaired as per page 3-2 #11 of Cleasby instruction manual. 3) Perform inspections of Cleasby truck mounted conveyor as per the manufacturer's inspection list, page 2 of 3. "Check control valve handles an labels, replace as necessary" 4) Train employees to recognize deficiencies, broken or missing parts that may result in the Cleasby Truck-Mounted Conveyor to operate in an unsafe manner, and to report to management those deficiencies, broken or missing parts. 5) Ensure that when deficiencies, missing or broken parts are reported that the vehicle is taken out of service until it fixed or repaired and can operate as per manufacturer's specifications.
