29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657: On or before August 31, 2018, the exposing employer did not ensure that employees working inside a trench with vertical walls were protected from cave-in, in that employees used a shovel to locate utility lines without using a protective system. The trench collapsed and caused severe injuries to at least one employee who suffered broken pelvis, broken ribs, and head injuries. The trench was approximately 6 feet in depth, 4 feet in width, and at least 20 feet in length. This condition exposed employees to a crushing hazard by excavation wall cave-in.
