29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) On or about September 11, 2017 and times prior: competent person for trenching: The employer failed to ensure a designated and qualified competent person was designated to conduct daily inspections of the trench for potential hazards prior to employees entering and/or throughout the trench work should conditions change during the day to identify items such as but not limited to egress, protective system, hard harts, water in the trench, and soil conditions.
