Text For Citation: 01 Item/Group: 005 Hazard:
29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired: (a)First Dakota Enterprises, Inc. at Hilgers Gulch Sanitary Sewer Line Project, Pierre, SD 57501: On or about and at times prior to June 29, 2017, the employer did not ensure that employees were not exposed to fall hazards as a result of employees using an extension ladder to gain access to the top of an 84-inch Corrugated Metal Pipe (CMP). The top right side rail was damaged. This condition exposed employees to a fall hazard of approximately 7 feet.
